Can't dismiss Navy Officer for Sex Messages: SC

On May 7th, 2013, Indian Navy dismissed an Officer N Kalyan Kumar of Mumbai after he was found guilty of exchanging sexual messages and nude photographs with a foreign woman who happens to be the wife of another Indian Navy Officer.
 
Kalyan Kumar than challenged his dismissal before the Armed Forces Tribunal. On June 25th, 2014, The Tribunal quashed the dismissal and given orders for his reinstatement.

It was then Centre approached the Supreme Court challenging the Armed Forces Tribunal's order of reinstatement. During the hearing, The Apex Court questioned how could the naval officer be dismissed when the exchange of messages between the two was consensual. The court opined an Indian officer having contact with a foreign woman or inviting her for breakfast can't be ground for dismissing from service. SC dismissed the petition filed by Centre paving way for the reinstatement of the naval officer.
