The Punjab and Haryana High Court passed a historic verdict. Yes, It permitted the jail inmates to have sex with their partners if they are married and wishes to have a child.
High Court Justice Surya Kant passed this order on the petition filed by a couple Jasvir Singh and Sonia who were the inmates of Patiala Central Jail. The two accused were awarded death penalty for alleged kidnap and killing of a 16-Year-Old Boy for Ransom. They filed a petition asking the court to allow them stay together for the sake of progeny. Jasvir Singh informed that they were arrested just 8 months post marriage and he is the only son of his parents.
Justice opined right of convicts and jail inmates to have conjugal visits or artificial insemination for progeny was a fundamental right.
