A school boy from Bareilly was arrested in Uttar Pradesh for allegedly posting objectionable comments on Facebook against Samajwadi Party leader. The boy allegedly commented his views on UP Urban Development Minister Azam Khan which was objectionable according to the latter.
Police arrested the kid and he has been booked under Section 66-A of the Information Technology Act and sections 153A (promoting enmity between different groups on grounds of religion, race, etc.), 505 (public mischief), and 504 (intentional insult with intent to provoke breach of peace) of the IPC.
Challenging the government's charges, Senior counsel Soli Sorabjee raised the matter to supreme court.The Supreme Court slammed the act of police and ordered the Uttar Pradesh government to explain the arrest of a boy. SC also granted bail for the boy and ordered UP government to file the explanation on the action. A Bench led by Justice J. Chelameswar gave the State four weeks to respond
Meanwhile, the student pleaded innocence in the case. During the police interrogation, the boy said that he did not understand the real meaning of content which he had posted on Facebook.
